Belgian subcontractor wage liability: keep the declaration and notice trail

A contract clause needs operational follow-through

Belgian construction activities have a special joint and several liability scheme for unpaid wages. The FPS Employment explains that a contractor using a direct subcontractor may avoid that liability under stated conditions when it holds a written declaration signed by both parties. The declaration includes the official website address for wage information and the subcontractor's confirmation that it pays and will pay the wages due to its workers.

The declaration can be a separate document or a clause in the contract. Either way, the company must be able to retrieve the signed version for the correct legal entities and scope. A standard clause in an unsigned template is not evidence.

Record the declaration before work starts

Link the signed document to the subcontractor and project. Capture the contract date, signatories and version. Check that the official website reference is present and that the declaration concerns the employer actually supplying the workers.

If the subcontracting chain changes, do not assume the original document covers every participant. Ask a qualified labour-law adviser which declarations and checks are required for the actual relationship. Software should expose missing evidence, not infer legal protection from a parent company name.

Treat a notice as a timed event

The official guidance states that liability may be re-established for future unpaid wages after the contractor becomes aware that the subcontractor is not paying wages, following the stated fourteen-working-day period. Awareness may arise through a Labour Inspectorate notification or other legal evidence.

Create a specific event when a notice arrives. Preserve the original, receipt channel and exact time. Assign legal review immediately and calculate no deadline from an informal summary alone. Record which sites, workers and invoices may be affected and place payment or access controls only under the approved legal procedure.

Preserve decisions and later evidence

Keep the initial declaration, every notice, advice received, actions taken and closure together. A later reviewer should be able to see why payments continued, were withheld or were escalated. Do not overwrite an old status after the issue is resolved.
